NEWPORT — Alan Wirkkala may stand trial in October on at least one of two felony sexual assault charges involving a girl that resulted in a split jury decision on Friday.
A bail hearing is scheduled for 1 p.m. today in Sullivan County Superior Court. Wirkkala, 51, of Newport remains incarcerated without bail at the county jail since his arrest in September.
On Aug. 9, Wirkkala was found not guilty by a jury on two counts of felonious sexual assault. The 14-member jury returned split decisions on two counts of felonious aggravated sexual assault following the two-day trial in superior court.
A judge dismissed three counts of felonious sexual assault based on language discrepancies in the indictments.
Sullivan County Attorney Marc Hathaway said that under New Hampshire law felony charges that result in a hung jury can be brought forward for a new trial later on.
“It is likely that one of the two deadlocked charges will be retried in October,” Hathaway said.
“There are multiple cases pending — multiple people who have come forward making complaints against Mr. Wirkkala,” he said and declined to comment further.
Defense attorneys argued last Wednesday there was insufficient evidence to convict Wirkkala, calling oral testimony by the alleged victim and her cousin “a story” and “a work of fiction.”
The alleged assaults took place between 1985 and 1987, and between 1987 and 1991 at various locations in Claremont. The alleged victim was between 5 and 12 at the time of the alleged incidents. During her two days of testimony last week the alleged victim claimed Wirkkala had invited her to play video games in his bedroom and then sexually assaulted her with his hands and nail clippers.
Hathaway said Monday Wirkkala is facing charges related to other alleged sexual assaults against minors that occurred in Sullivan County.
Court officials said documents related to multiple active cases against Wirkkala would not be available until after today’s bail hearing.
According to media accounts, Wirkkala faces at least 20 felonies connected to alleged sexual assaults against four children during the 1980s and early 90s.
In November, Wirkkala was indicted on charges related to a 15-year-old girl he allegedly assaulted in a cemetery in 2012.
